These Terms of Service ("Terms") govern your access to and use of Chatsa ("the Service"), provided by Kerala Digital Marketing ("we", "us", "our"). By signing up or using the Service, you agree to these Terms.

1. Description of Service

Chatsa is a SaaS platform providing AI-powered chat widgets for business websites. The Service enables businesses to embed a chat widget to engage visitors, capture enquiries, and manage appointments.

2. Account Registration

You must be at least 18 years old to register. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

3. API Keys and AI Usage

Chatsa operates on a bring-your-own-key (BYOK) model. You provide API keys from Anthropic (Claude) and optionally OpenAI. By doing so, you agree that:

You agree not to use the Service to violate laws, transmit spam or malware, misrepresent your identity, interfere with the Service, harvest personal data without consent, or for any unlawful purpose.

5. Plans, Billing and Payments

The Service is offered on a Free plan and a paid Pro plan. By upgrading, you authorise us to charge you via PayU (India) or Paddle (international). Subscriptions renew automatically unless cancelled before the renewal date.

7. Intellectual Property

The Service is owned by Kerala Digital Marketing. You retain ownership of your content and grant us a limited licence to process it solely to provide the Service.

8. Data and Privacy

Your use of the Service is governed by our Privacy Policy. You are responsible for obtaining necessary consents from your end users.

9. Limitation of Liability

To the maximum extent permitted by law, our total liability to you shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. We may modify or discontinue parts of the Service with reasonable notice.

11. Termination

We may suspend your account for violations of these Terms. You may terminate your account at any time from your dashboard settings.

12. Changes to Terms

We may update these Terms and will notify you of significant changes by email. Continued use after changes take effect constitutes acceptance.

13. Governing Law

These Terms are governed by the laws of India. Disputes are subject to the jurisdiction of the courts in Kerala, India.
